2043-00018: Talons File Lawsuit Against Tow Truck Company That Was Supposed to Help SP Don Smith Change His Flat Tire

Phoenix, AZ--

The Talons have reportedly sued the roadside assistance company that was supposed to help one of their pitchers change a tire.

In the suit Central Arizona Concessions, Inc. (dba Talons Base Ball Club LLC) v. GlobalAutomotive AmericaCorp (dba Smitty's Towing and Wrecking Service LP), the Talons are suing for upwards of $4,000,000 in damages stemming from the incident on July 16th that resulted in a shoulder injury to one of the JL's best young starting pitchers.

As is the case in matter such as these, the parties are not issuing any statements on the pending litigation. But according to past press releases, on July 16th, 2043, Talons starting pitcher Don Smith was on his way to the park in his vehicle when it suffered a flat tire. He informed team officials, who then called emergency road services for assistance. Later, it was revealed that the tow truck never actually showed up, and Smith attempted to change the tire himself, resulting in the shoulder injury.

Publicly available road cameras from the Arizona Dept. of Transportation on the date in question appear to show a black pickup truck on the shoulder of northbound Interstate 17. The truck appears to remain on the shoulder for at least two hours. Then, someone exits the truck and attempts to change the tire. Cameras show the person struggling to loosen the lugnuts, then appearing to slip, catching themselves on the ground, and getting back into the truck. Hours later, another vehicle appears to pick up the person, leaving the truck along the side of the interstate until it was recovered by Phoenix Police later that night.

As for the amount of the suit, speculation in Phoenix asserts that the 4,000,000 dollars is roughly equivalent to Smith's salary for the second half of the season, plus the cost of his AAA replacement on the ML roster, plus the impound fee to recover his pickup truck.
